| Note from the Clerk's Office Welcome to the second edition of our newsletter. This newsletter will be produced periodically to update all of our e-filers on news that applies to CM/ECF. We will also provide tips and reminders to help your electronic filing experience be a pleasant one. Please share this information with all of your support staff who assist with filing in CM/ECF. Electronic filing is now MANDATORY in all criminal cases. If you are not yet a registered e-filer and have not yet signed up for a training session, please do so today! Notice of Appearance Required for Each Attorney of Record When an attorney e-files a Notice of Appearance (with multiple attorneys shown in the Counsel Submitting and Utah State Bar area on the Notice), pursuant to Local Rule 83-1.3, only the signing attorney will be added to the case. There is now a message that shows within the attorney event: NOTE: Each Attorney must enter his/her own appearance - See DUCivRule83-1.3. So, if there is more than one attorney in a law firm making an appearance, all the attorneys will need to file their own electronic Notice of Appearance. Think You Missed A Notice From The Court? There is now an easy way to make sure that you are receiving all of your notices from the Court. Click on Reports on the Blue Main Menu Bar. Under "Local Reports" click on "Emails Sent". Enter a date range you would like to check and run the report. Questions About Filings Many people have questions about documents that have been filed when they receive the notification in their e-mail. Please DO NOT respond to the notice as this address is only used to send the notices. If you have questions about a document, please contact the Clerk's Office at 801-524-6100.

Changes You Should Know About Under Civil Events we added to the name of "Responses and Replies"; it is now "Responses, Replies and Other Motion Related Documents" ![]() DOCKET TEXT SEQUENCE- Now allows the user to specify the sequence when docketing multi-part events such as multi-part motions. The order in which the events are selected is how they will appear in the final docket text. QUERIES - Any list of cases brought up will now include the closed date. Criminal cases will list both the main case and each defendant case. There are now new options to run query for Open Cases, Closed Cases or Both by case or by person name and type. CHANGES TO THE NOTICE OF ELECTRONIC FILING (NEF) - The NEF now reflects whether an attorney is an e-filer. If you want to determine whether an attorney is an e-filer prior to submitting your document you may still click on Utilities on the Blue Main Menu Bar. Click on Mailings which is under the Miscellaneous heading. Click on Mailing Info for a Case. The attorneys who are e-filers will have (E-Filer) next to their name. How Do I File ____? Situation: An attorney who is not an e-filer files the document on paper and sends a copy to the other attorneys on the case. The attorney who received the document wishes to respond to the filing by filing their response electronically. When the filer tries to respond he/she find the first document is not yet on the system. Response: The Clerk's Office continues to docket pleadings as quickly as possible. There may be a delay though due to staff shortages and/or additional duties. The docket clerks are still docketing all paper filings and they now are Quality Checking all documents that are electronically filed by attorneys. If you can not find the document on the docket, please contact the Clerk's Office and we will attempt to locate the document and place it on the docket as quickly as possible. Situation: As an e-filer you wish to respond to a document that is not a motion and may not even be on the docket (if it was something filed by a pro se party.) Response: In these instances you would use the "Response (Not to Motion)." In civil cases this is located under the heading "Initial Pleadings and Service." Click on "Other Answers and Responses". From the box select "Response (NOT to motion)." In criminal cases this is located under the heading "Other Filings." Click on "Other Documents." From the drop down box select "Response (NOT to motion)." |
