The United States District Court for the District of Utah provides the bar, the press, and the public with efficient remote electronic access to court information.(1) The name of this service is "Public Access to Court Electronic Records" or "PACER."
PACER allows users -- members of the bar, the public, and others -- to access civil and criminal case information electronically and remotely through use of a terminal or computer and modem. Users simply dial a special court number, connect to a special public information computer, and request case-related information. The system can provide lists of cases, searched by name, as well as the full electronic docket for the case. Users have the option of saving the docket on their own computer or of printing it out in their office or any other location equipped with a printer. Through the use of PACER, users no longer are compelled to physically come to the court or place requests for court information in writing; they now can obtain docket information on any of the hundreds of civil and criminal cases in the district court that have been docketed electronically. The court electronic database contains dockets for virtually all civil cases filed on or after July 1989, and for many of the civil cases that were filed earlier but remained active in the latter half of 1989. The database also provides access to dockets in criminal cases filed after November 1992.
PACER has proven to be a useful and economical source of information for users who need accurate data about civil and criminal cases filed in this court. With PACER users are able to:
Track updates to a case of interest -- in less than a minute, users are able to determine whether anything has happened in one or even several cases they may be tracking.
Get a printed history of a case -- in fewer than 30 seconds, users are able to retrieve the entire electronic docket of a typical case, a copy of which then can be printed.
Research case parties by name -- for example, users are able to search for all the cases where "ABC Manufacturing" is a litigant.
1.2 Required Equipment and Software
To utilize the PACER system, prospective users will need communications software, certain types of computer equipment, and an available telephone line. Please note that the court is not in a position to provide technical assistance in loading or setting up equipment to enable users to access PACER or in diagnosing and solving problems users may experience with their equipment. To that extent, users might wish to consult with their equipment vendor regarding the set-up of their equipment and any difficulties they experience when accessing PACER.
Software: To access PACER, users will need an appropriate communications software package such as PROCOMM PLUS, KERMIT, CROSSTALK, SMARTCOMM, or other. These are all off-the shelf commercial applications that can be purchased at a relatively modest cost from computer software vendors.
Computer or Terminal: The primary piece of equipment is a computer. Users also can access PACER with a terminal, but a computer offers them the advantage of (1) saving the information they have accessed by downloading it onto a disk for later review, (2) printing the information for further reference, and (3) if they so wish, editing the information, such as with a word processor, once they have downloaded it. However, if all users wish to do is look at and review the information on the screen, a simple terminal will suffice.
Printer: If users wish to preserve the information that they have extracted from PACER on paper, they should plan on having a printer. Generally, it is much easier to read and to study a printed docket. Moreover, once users are finished with it, they can file it away as a document for future reference.
Modem: The court's system will respond to calls from either 14.4, 9600, 4800, 2400 or 1200 baud modems. The number indicates speed of transfer of information; a 2400 modem is twice as fast as a 1200 modem. We recommend a 14.4 baud modem, even though it is more expensive, because users will spend less time waiting for the information they have requested. The faster modem makes the system more efficient and more pleasant to use, particularly if users are downloading large docket reports. (Users who only have a modem with a baud rating lower than 9600 available should try sending a [BREAK] to the system or depressing the ENTER or RETURN key several times if they fail to get an "ID:" login when they first connect.
Telephone Line: Users will need a standard telephone line with a standard plug to connect to their modem. If users plan on using PACER only occasionally and they have a line that they can disconnect temporarily from a telephone, there is no need to have an additional line installed. When anyone uses PACER, they need simply disconnect the line from their telephone and plug it into their modem. When they are finished with their PACER session, they simply connect the line back to their telephone.
Our system is set for 8 bits, 1 stop bit, and no parity. Apart from those specifications, it is ASCII, pure and simple. Users who do not know what these specifications mean should try to dial in to the system with the equipment they have. They may have no difficulty. If they do experience difficulty, they should contact their vendor or a technical expert for assistance.
1.4 PACER Access Telephone Number
To set up your Pacer account, users must call the Pacer Billing Center at 1(800) 676-6856. After an account is established for you and a user password assigned, users may access this district's dockets.
The dial-in modem number for the PACER system in the District of Utah is (801) 524-4221 or 1(800) 314-3423. It is a local Salt Lake City number, but like any commercially accessible number, it can be dialed and the system can be accessed long-distance from virtually any location. Thus, the service is available to local attorneys who are in travel status as well as to out-of-state attorneys who have signed up and been issued passwords.
For users who are using a computer rather than a terminal, the most efficient way to utilize the system is to set their communications software to perform a continuous save to disk(2) while they are connected to the court's system. Then, when they have finished their inquiry, they have the option of saving the information in a file and printing it out for review and reference. Alternatively, they may wish to activate the save-to-disk function only after they have selected a case for which they wish a docket report but before they respond to the report (y/n) question. Under this option, users save to disk in a file only the reports they actually need, and they do not have to edit extraneous data that is of no use to them.
If, alternatively, users are relying on a printing terminal, it will produce a printed version of the entire session. Often, even a simple terminal can be set up to provide continuous print. Either way, this option provides users with a paper copy of the results of their search.
When the data from the PACER system reaches a user's machine, it is relatively clean. That is, we have removed all of the hardware-specific codes from the information that is being transmitted to the user. Thus, regardless of what the brand of printer or terminal/computer users are relying on, they probably will have little trouble printing reports of the information they receive. Please note that formfeed codes ([ctrl][L]) are used to separate the pages. For most hardware configurations, this code will automatically advance the printer to the next page, which is just what users want. If not, users can edit the data by deleting the codes and adding their own pagination as they wish, using their own editor or word-process system.
The data that is transmitted to the user's system will be formatted for the "80 column screen" image used in microfiche production, so users will need a printer that is capable of accepting output at least that wide. Pagination is designed to be suitable for standard eleven-inch (11) paper, so most printers will have no difficulty accepting and printing out the data as it is transmitted by PACER.
1.7 Timeliness of the PACER Information
The PACER system runs on a computer that is separate from the primary computer system utilized by the court. Thereby we are able to offer PACER as a public service without unduly burdening the operation of the court's system. This creates a slight disadvantage for PACER users with regard to the timeliness of the information they receive. The PACER computer is updated by the court's primary computer on a daily basis, typically in the morning. The update process makes available to the PACER computer all new information posted to the court's primary system the previous day. Thus, if a user accesses PACER at 12:30 p.m. for an update on what has transpired in a particular case, the user will not see, for example, a docket entry added earlier that morning; such entries will not be available on PACER until the morning of the following day.
Thus, in general, case filings and updates to the docket will not appear on the PACER system until the day after they are entered on the main court computer. Of course, occasional technical difficulties either with the PACER system or with the court's primary system may cause longer delays. If we experience major difficulties with the timeliness of the information, our systems manager will place a message on the PACER system, and it will appear on the users' screen when they sign on.
PACER is a fully operational public access system for the United States Courts. All non-Judicial Branch users in both the private and public sectors (federal, state, and local) are charged a standard usage fee that is established nationally by the Director of the Administrative Office of the United States Courts under the supervision of the Judicial Conference of the United States. The current charge is sixty cents ($.60) per minute of connect time. PACER users are not billed by the court; the Judicial Branch has established the PACER Billing Center in San Antonio, Texas. The PACER Center will bill all users on a quarterly basis and is in a position to provide printouts of time spent on line for registered users. Registration for use of the PACER system and distribution of user passwords to access PACER also are handled by the PACER Billing Center. Instructions are set forth below in Section 1.11.
Because we are offering the system to serve as many users as possible, PACER has been programmed to monitor users to ensure that one person does not unduly tie up the system while others are waiting for it. Currently, there are two categories of time limits that PACER monitors:
Idle Time: If, after users have logged onto PACER and made an inquiry, they then turn to do something else, PACER will issue a warning that if they do not resume activity, it will log them off the system. The current time limit is one and one-half minutes or 90 seconds. If they do not resume their inquiry after the warning, PACER will log them off.
Session Time: Once users are logged onto PACER, they have approximately ten minutes to complete their inquiry. Again, PACER will warn them when the ten-minute limit is approaching.
Users may encounter other limits to how much they can get from this system. For example, there are built-in limits as to the maximum number of people and cases users are allowed to match at one time. However, users should have little difficulty with these if they type in a fairly complete name and if they avoid searching by very common litigant names.
1.11 Registration as a PACER User
Use of the PACER system requires that users obtain the necessary instructions or documentation -- such as this manual -- and that you register with the PACER Billing Center in San Antonio, Texas, by calling the toll-free number: 1-800-676-6856. When registering for PACER, users should indicate all federal districts to which they would like to have PACER access. Although not all districts currently have PACER, the number is growing. Users should bear in mind that each district has its own telephone access numbers. Once users have registered, they will receive a personal ID/password for access to the system. Again, currently there is no charge for registration.
As a matter of convenience to our clientele, we are making access to PACER available for users to extract civil and criminal case information around the clock, seven days a week. There should be no breaks in service.
All users are invited to share their comments and suggestions about the PACER system with the representatives of the Technology Enhancement Office of the Administrative Office of the United States Courts. Comments and questions regarding PACER or other electronic public access projects are welcome. 2.1 Understanding CIVIL and CRIMINAL Case Numbers
If you are a relative newcomer to federal trial practice and dealing with the United States District Court, you may be unfamiliar with the four-part case numbers that are utilized by the court. Let's look briefly at the parts of typical civil and criminal case numbers, for example,

Division Number: Currently, the District of Utah consists of two divisions, Northern which the computer system identifies as "1", and Central which the system identifies as "2."
Case Year: All cases opened in a given year include the last two digits of the year as the second part of the case number.
Case Type: Each case number also specifies the type of case. The letters "cv" signify that this is a civil case; "cr" signifies that it is a criminal case.
Case Identification Number: The last four digits in the case number identify the sequence in which the case was filed in the calendar year. For example, the first case filed in a new calendar year is assigned the number 0001, the second 0002, and so forth.
All four parts of the case number are needed to uniquely identify a District of Utah case. Fortunately, however, if you omit the case type or office designation when querying the PACER system, it will list for you all cases which match the year and number you entered. You then can select from the list the one you wish to review.
2.2 Understanding CIVIL and CRIMINAL Docket Reports
If you have never reviewed case dockets that are maintained on or printed out by the court's computer system, please take a moment to review the sample report on the following pages. These reports function as the official record of a case, and they are used primarily by individuals who are very familiar with the format in which they are produced. The sample docket report illustrates features of the report that, on first review, may be confusing.
Refer to the illustration as we review the features of a typical report.
The information at the top of the report is obtained from the JS-44 Civil Cover Sheet submitted by the plaintiff at the time the civil complaint was filed. The parties are listed on the left; the names, addresses, and telephone numbers of counsel for each party are listed on the right side of the report.
Typically, after the various parties and counsel have been listed, a page break [using Ctrl L formfeed] starts a new page that lists the initial events in the case. Occasionally, a complex case may include several pages of parties and assorted counsel.
Additional features of a typical docket report include:
Docket as of...: This indicates the date and time the report was processed on the court's main computer.
Nature of Suit: This number is taken from the JS-44 Civil Cover Sheet form completed and submitted when the case was filed. The number or code reflects the nature of the suit as set forth on that form. You may wish to review the form for a better understanding of the codes structure it utilizes. Major categories of codes include the following:

Criminal cases are identified by the relevant section of Title 18 of the United States Code that specify the criminal activity with which the defendant is charged.
Jurisdiction: This entry specifies the basis for filing the complaint in a federal as opposed to a state or local court. It asserts that the cause for the action falls within the jurisdiction of the U.S. District Court
Cause: This entry specifies the federal statute under which the complaint is being filed. It specifies the applicable title and section numbers as well as a brief description of the statute.
Lead Docket: This entry specifies the case docket number of the lead case for a series of cases that have been consolidated or joined by court order. Examples are multi-district litigation cases (MDL) and cases that have been consolidated because they share common parties or causes of action.
Dkt # in Other Court: This entry specifies the case docket number from another court. Examples include cases such as a bankruptcy appeal, removal from state court, and transfers from other federal district courts.
Case Type: This entry specifies the major category under which the case falls -- civil, criminal, magistrate or miscellaneous -- and the applicable sub-category, if any.
TYPE E/Jury: There may be additional codes or notations at the top right side of each docket page. These local court codes or words represent special case identifiers for court or case management processing.
[COR LD NTC:] The entry COR designates Counsel Of Record; LD designates Lead Attorney; and NTC for Notice to Counsel indicates that the attorney so designated will receive case-related notices from the court. In some case dockets, this entry also may include PRO SE, indicating that the party is representing itself in the action.
4/19/88: The succession of dates on the left side of the docket report indicate when the document was filed with the court or when the event occurred.
1, 2, 3, etc: The sequence numbers that follow the date are the numbers assigned by the clerk to the documents that are filed in the case. Each document so filed receives its own unique identification number; in larger cases with numerous documents, such numbers can run into the hundreds, occasionally thousands. Such documents are placed into the case file sequentially by the number assigned to them. If a "-" appears in this space, it simply indicates that no document was filed in conjunction with the event that is docketed.
(CE): The letters in parentheses at the end of a docket entry are the initials of the deputy clerk who docketed the entry.
[Entry date 4/20/90]: The entry signifies the date the event was entered onto the electronic docket; it appears only if the entry date differs from the corresponding filing date indicated on the left side of the report.
[Edit date 4/25/90]: This entry reflects the date this event was edited by a deputy clerk.

2.3 Outline or Skeletal Dockets
The court began to docket all new civil cases electronically in early July, 1989, and all criminal cases in November 1992. PACER is capable of providing access to the complete dockets of virtually all cases filed since these times. The only exceptions are sealed cases and pleadings. When the court began electronic docketing, it decided to incorporate into the electronic docket all civil cases that had been filed prior to July 1989 and that were active or pending in the court. However, transferring the existing paper dockets for these older cases to the electronic docketing system in their entirety would have taken two or three years. Thus, the court determined to transfer only an outline or skeletal version of those case dockets to the electronic system. Each existing docket was reviewed and only those events that were deemed critical or important in the life of the case were transferred to the electronic docket. Once an older case was so transferred, however, all new entries occurring after the transfer are being fully docketed on the electronic system. Thus, for a number of cases, the earlier portion of the complete docket will be on paper in court files; a skeletal version of the earlier entries and a complete version of the later entries will be on the electronic system.
Please note that criminal cases were indexed prior to November 1992; complete dockets for criminal cases filed after that time are available on PACER.
What this means for you as a PACER user is that on occasion you may pull up a docket whose initial series of entries appears incomplete. What you are looking at in such instances is one of these skeletal dockets. If you need to see all of the earlier docket entries for the case you are reviewing, you'll have to come to the clerk's office to review it or to request that a copy of the paper docket be prepared for you.
2.4 Getting Answers to Questions
If you have questions about the case-related information you obtain from the PACER system, such as
* How far back does the data that is available on PACER extend
* How long does it take, once a motion, pleading, or order is filed, for it to appear on this system
* What do I do if I know that an older cases exists, but PACER has no record of it
*What do I do if I have a question about a docket entry in a specific case
you may contact the court directly. For answers to docket questions call the docket clerk assigned based on the last two (2) digits of the case number. The clerks and the telephone numbers are listed below.

Unfortunately, the court does not have the resources to provide extensive technical assistance if you experience technical difficulty in bringing PACER up on your computer or terminal. In such instances, please contact your equipment vendor or a local technical expert. If you have technical questions about PACER or if you wish to report an apparent problem with PACER, please contact the court's Systems Manager, Frank Koegler, at (801) 524-6104.
If you decide you would like to take advantage of the benefits PACER offers, you should begin by taking the following preparatory steps.
* Obtaining your equipment and getting it in place
* Registering with the PACER Billing Center
* Obtaining your identification code and password from the Center
* Determining what specific case information you need
* Obtaining the relevant case number or party name
If you are using a terminal, with or without a printer, switch everything on. If you are using a computer system, use your standard start-up procedure. To communicate with PACER, you will need to use a modem capable of 14.4, 1200, 2400, 4800, or 9600 baud transmission rates and should set your equipment at 8 data bits, one stop bit, and no parity. This standard setup may already exist as the default for your system.
3.2 Dial (801) 524-4221 for local calls or (800)314-3423 for long-distance calls
Use your modem to dial the court's public access system. You should receive an ID: prompt shortly after the connection is made. If you do not, depress the RETURN or ENTER key several times.
Enter the user name and password given to you by the PACER Billing Center.
At this point, you should be prepared to enter the references for the case docket you wish to review. You may specify either the case number or a participant name.
Case Number: If you have a case number, just type it in at the prompt. If you know all the parts (the office number, the year, the case type, and the number) you can immediately get the docket report.
If you have only a partial case number, try typing in those parts of it that you do know. For example, type 88-123 or 88 123 if you do not know the office or the case type. If only one case in the court's automated case inventory matches the parts you supply, PACER will refer you to that case and you will be able to pull up the docket report. If the inventory contains more than one case, PACER will list the applicable cases and you will be able to select the one you need.
Party Name: If you have a party name, type it in when you are prompted to do so. Use the format last, first, & middle. Capitalization is not necessary. Then press RETURN or ENTER. The system will look for matching party names. If there is more than one matching name, PACER will list them and you will be able to select the one you need. Once you have selected a name, the system will search the database to determine whether that party is involved in more than one case. If not, you will be able to obtain a docket report. If the party is involved in more than one case, PACER will list each case and ask you to select the one in which you are interested.
You may type either the party's entire name or a partial name. For example, you may want to look up cases to which "Millerville Canning and Bottling Corporation" is a party. It could be typed as:

This electronic wildcarding technique also can be used with the names of individuals by entering only a part of the name rather than the entire Last, First, & Middle name. For example, "Peter Phillip Gordon" could be typed as:

You may use this new public information program in a variety of ways to obtain the specific information you need. Here are some special features and techniques designed to minimize user time and effort.
With PACER, you do not have to know all four parts of the case number: office, year, type, and number. Only year and number are required. The system will search for the case or cases whose numbers correspond with what you provide, and it will list the choices from which you may select.
For example, if you need to review the docket for case 97-1234, begin by typing that number into the system. If more than one case exists with that year and number -- for example with different office codes or different types -- the system will list each case with that common year and number. You then can make your selection.
There may be times when you are tracking several cases with a common party, and you already may have retrieved the docket during an earlier PACER session. The second time around, when you get to the case list under selecting by person, you simply may wish to review the last update date to determine whether there are new events that would justify the need to obtain a new docket report. If there are none, you will not have had to go to the trouble of retrieving a report you already have.
You may use PACER to learn more about other cases involving the same party. For example, if you are working on a suit against XYZ Corporation, you may wish to have PACER search the database by corporate name to determine whether other parties have actions pending against the company.
The court's primary computer system currently contains the names of more than 50,000 individuals and organizations in its CIVIL database. The PACER system will search for a party(3) in any variation you provide. However, using the system is much more efficient where you specify the party name the same way that it was entered on the computer. There are several ways in which this can be simplified.
Various deputy clerks employed in clerk's office enter case information into the court's primary computer, and there may be variation in how a particular party name is entered. Although the court recently implemented a system of standard abbreviation styles to facilitate uniformity, some of the early case entries do not conform to it and have not been modified. Thus, when conducting a PACER search you may have to enter several variations before PACER identifies the party you seek. For example, the United States Air Force could be entered in several ways:
-- United States Air Force
-- U.S. Air Force
-- U.S.A.F.
-- Air Force
If your first attempt to search a name is not successful, try using a more imaginative approach. Often, lengthy common words are abbreviated.(See Appendix A.) Examples are "ASSN", "DEPT", and "CORP". If you continue to have difficulty determining precisely what to use for the abbreviated text of a search you are conducting, contact the Intake Office at the number noted above.(4)
It is possible to search for a case with PACER using the names of any party to the case. However, names that represent the most active litigants, such as USA, are not particularly good choices for searches. Where you use a party that is likely to be a litigant in a large number of cases, the system will conduct a lengthy search, then eventually inform you that too many cases were selected for an effective search to continue.
The solution is to find a more unique identifier or litigant name to search for the case in which you are interested. If, for example, you wish to search for the case John Q. Watchburg vs. USA, you should search by Watchburg rather than USA.
