Scheduling conferences, all motions, and pre-trial conferences are handled by the Judge, usually in open court after notice.
Initial status conferences, other status conferences, pre-trial conferences, and all motions are heard in open court.
A final pretrial conference is held in open court in every civil case awaiting trial, at which time a firm trial date is set. Judge Jenkins requires the submission of an agreed form of proposed pre-trial order signed by all counsel and containing a statement of triable issues, a complete roster of witnesses and exhibits; and requires the attendance of trial counsel at pre-trial, prepared to talk issues, theory, authority, and facts. See DUCivR 16-1(c)-(e) and Appendix IV to the Local Rules.
Judge Jenkins begins trial at 9:30 a.m. and usually runs until 5:00 p.m. There is usually one break in the morning and one in the afternoon, with a lunch break from 12:00 to 1:30 p.m.
In jury trials, the court conducts the voir dire. Supplemental questions will be considered by the court, and submitted as per the local rules. See DUCivR 47-1(b), (c).
Judge Jenkins permits requested jury instructions to be submitted via email in electronic format (WordPerfect or MS Word), provided that one original copy, numbered and with citations, is filed in paper form or e-filed in .pdf format as "[Plaintiff's/Defendant's"] Requested Jury Instructions."
