• Hearings may be requested by written motion or by calling the case manager at (801) 524-6617 or by email at utdj_stewart@utd.uscourts.gov
• TRO Hearings will not be set prior to the filing and review of the Motion for a TRO. Absent extraordinary circumstances, Judge Stewart will not set a TRO hearing without allowing a brief opportunity for the opposing counsel to respond. If you seek a hearing without time for opposing counsel to respond, please include the reason in your written motion. The requirements for obtaining an ex parte TRO are set forth in Fed. R. Civ. P. 65(b).

II. Page Limitations:

Page limitations for memoranda are set forth in the Local Rules. Exceptions are rarely granted and only upon a showing of good cause.

III. Proposed Orders

Proposed orders must be submitted in a format compatible with WordPerfect, which is a "Save As" option in most word processing software. Proposed orders should not be submitted in .pdf format. The proposed order shall be e-mailed to utdecf_stewart@utd.uscourts.gov. If objections to the order are still unresolved, the party objecting should e-mail their objections and that party's proposed revision of the order also to utdecf_stewart@utd.uscourts.gov. All e-mails to the Court shall be copied to all counsel.

IV. Trial Procedures and Practices

Judge Stewart's Trial Order sets forth his practices and procedures for trial and specifically addresses such trial matters as the form of the Pretrial Order, the Jury Instructions, Voir Dire, Trial Briefs, Motions in Limine, Exhibit and Witness Lists, and Courtroom Conduct. VI. Jury Instructions

Judge Stewart has stock jury instructions for civil and criminal cases.

VII. Voir Dire

Judge Stewart has stock voir dire. [Link to stock Voir Dire] See the Trial Order for procedures re: Voir Dire. Absent extraordinary circumstances, Judge Stewart does not use a jury questionnaire.

VIII. Courtroom Equipment

Easels, a TV Monitor and VCR and an electronic evidence presentation system are available. Please call case manager at (801) 524-6617 to arrange for use of electronic evidence presentation system for use at trial.
