Notice on Privacy to Members of the Bar and Litigants

In compliance with Section 205 of the E-Government Act of 2002 and the policies of the Judicial Conference of the United States, the District of Utah provides electronic access to most court documents filed in civil and criminal cases via PACER, with exceptions for sealed cases or documents.

Redaction of Personal Identifiers and Sensitive Data
To protect privacy and safety, certain documents filed electronically must be redacted to remove personal identifiers or sensitive data before they are publicly accessible. Redaction is required under Fed. R. Civ. P. 5.2, Fed. R. Crim. P. 49.1, DUCivR 5.2-1, and DUCrimR 49.1-1.

In Civil Cases:
Documents containing personal identifiers or sensitive data should only include the following:

  1. The last four digits of the social security number and taxpayer-identification number.
  2. The year of the individual’s birth.
  3. The minor’s initials.
  4. The last four digits of the financial account number.

In Criminal Cases:
Documents containing personal identifiers or sensitive data should only include the following:

  1. The last four digits of the social security number and taxpayer-identification number.
  2. The year of the individual’s birth.
  3. The minor’s initials.
  4. The last four digits of the financial account number.
  5. The city and state of the individual’s home address.

Sealing of Documents
Under the E-Government Act, a party needing to file a document containing personal data identifiers or sensitive data may request that the case or document be sealed, in accordance with DUCivR 5-2, DUCivR 5-3, or DUCrimR 49-2. The Clerk of Court will not review documents for compliance with redaction requirements, and it is the responsibility of the filing party to ensure redactions are properly made.
