II. Proposed Orders:

In addition to attaching a copy of the order to the motion, a copy of all proposed orders must be directly e-mailed to chambers at the following address: utdecf_waddoups@utd.uscourts.gov. Proposed orders e-mailed to chambers must be editable and submitted in either WordPerfect or Word format.

III. Dispositive Motions

Courtesy copies of all dispositive motions, memoranda and exhibits are to be provided to chambers at the time of filing or no later than the conclusion of briefing. 

Copies should be double-sided and printed from CM/ECF so that the court’s docket header and page numbering are visible. If counsel prefers, black and white exhibits to dispositive motions printed from CM/ECF can be replaced by color copies. If exhibits to any filing exceed twenty (20) documents and/or are voluminous in nature, counsel are instructed to provide an index of the exhibits (which should be attached to the filing) and, if possible, provide a CD containing a searchable version of those exhibits. See DUCivR 56-1 for requirements for motions for summary judgment.

Hearings are generally not scheduled until all briefing on a matter has been completed. Then, cases are typically scheduled in the order that briefing is completed

IV. Exhibits

If exhibits to any filing exceed twenty (20) documents and/or are voluminous in nature, counsel are instructed to provide an index of the exhibits (which should be attached to the filing) and, if possible, provide a CD containing a searchable version of those exhibits. See DUCivR 56-1 for requirements for motions for summary judgment.

All exhibits counsel anticipate will be used at trial are to be pre-marked and presented to the court in both hard copy and electronic media. The acceptable electronic formats are pdf, jpeg, wma or wmv. At the commencement of trial an electronic copy of the exhibit list and an electronic copy of each exhibit will be submitted to the Courtroom Deputy to manage and track the exhibits offered and received at trial.

V. Pretrial Orders

Ninety (90) days prior to trial in civil cases and 45 days prior to a criminal trial, the Court will issue a Pretrial Order explaining the Court's trial procedures and setting deadlines for the filing of motions in limine, proposed voir dire, and proposed jury instructions.

VII. Telephone Appearance Procedures:

Telephonic appearances are allowed in all matters before Judge Clark Waddoups with the exceptions of Trials and Evidentiary hearings (all counsel and all witnesses must appear in person unless approved by the Court in advance for good cause shown) and such other matters a designated by the Court as requiring a personal appearance.

Counsel who wish to appear telephonically should contact the Court's case manager at 801-524-6600 to make arrangements for their appearance.
